Terms of service

These Terms of Service govern access to and use of hillhousehomehx.shop and purchases made through the website.

By accessing our website or placing an order, you agree to these Terms to the extent permitted by applicable law.

Nothing in these Terms excludes or restricts mandatory rights provided to consumers under French or European Union law.

1. Store Information

hillhousehomehx.shop operates an ecommerce website through which customers may browse and purchase available products.

Customer-service enquiries may be directed to:

info@hillhousehomehx.shop

2. Application of These Terms

These Terms apply to website visitors and customers purchasing products through hillhousehomehx.shop.

Our Return & Refund Policy, Privacy Policy, Shipping Policy and Legal Notice should be read together with these Terms.

French B2C sellers are required to provide consumers with contractual sales information before the contract is concluded.

3. Eligibility

By placing an order, you represent that you have legal capacity to enter into the transaction or are otherwise legally authorised to do so.

You must provide accurate and sufficiently complete information during checkout.

You may not use the website or our services for fraudulent, unlawful or abusive purposes.

4. Product Information

We make reasonable efforts to provide accurate product descriptions, images, prices, measurements and other relevant information.

Minor variations in colour or appearance may occur because of screen configuration, photography, lighting or normal manufacturing differences.

Nothing in this section limits the requirement that goods supplied to consumers conform to the contract and applicable statutory standards.

5. Prices

The price applicable to an order will be displayed before checkout is completed.

Where required, applicable taxes and charges will be handled in accordance with the checkout configuration and applicable law.

We reserve the right to correct obvious technical or typographical pricing errors where permitted by law.

If an obvious pricing error affects an order, we may contact the customer before fulfilment and take appropriate action in accordance with applicable consumer legislation.

6. Orders and Formation of Contract

Submitting an order constitutes a request to purchase the products contained in that order.

After submission, an electronic acknowledgement or order confirmation may be issued.

We may reject or cancel an order for legitimate reasons including product unavailability, inability to authorise payment, obvious pricing errors, suspected fraud, incorrect delivery information or legal restrictions.

Where an order is cancelled after payment has been collected and no product will be supplied, the appropriate payment will be refunded.

7. Payment

Customers must pay the total amount displayed at checkout using an accepted payment method.

Payments may be processed through Shopify Payments or other third-party payment services.

Payment services may apply independent verification, security and fraud-prevention measures.

8. Shipping

All orders qualify for free standard shipping.

Our standard delivery timeframe is 15–20 calendar days, unless a different delivery commitment is expressly presented and accepted during checkout.

Further information appears in our Shipping Policy.

French consumer rules require sellers to communicate and respect a delivery date or delivery period.

9. Risk and Delivery

Products are delivered to the address provided during checkout.

Customers are responsible for ensuring that their delivery information is accurate.

Risk in consumer goods transfers in accordance with mandatory applicable consumer law and will not be transferred earlier merely because these Terms say otherwise.

10. Right of Withdrawal

Qualifying consumers purchasing online generally have a statutory period of 14 days following receipt of goods within which to notify the seller that they wish to withdraw without giving a reason.

After exercising the right, qualifying goods generally must be returned within a further 14 days.

Detailed instructions are contained in our Return & Refund Policy.

11. Legal Guarantee of Conformity

Nothing in these Terms limits statutory guarantees available under French consumer law.

The French legal guarantee of conformity generally provides consumers with a two-year period from delivery to exercise rights concerning qualifying conformity defects.

Where applicable, statutory remedies may include repair or replacement and, in circumstances established by law, a price reduction or termination and reimbursement.

12. Hidden Defects

Mandatory rights relating to hidden defects under French law remain unaffected by these Terms.

Where the statutory conditions are satisfied, a consumer may have remedies separate from the legal guarantee of conformity and the 14-day withdrawal right.

13. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy and applicable mandatory consumer law.

Any contractual return condition that conflicts with a mandatory statutory consumer right will not override that statutory right.

14. Promotions

Promotional codes, discounts or special offers may be subject to specific conditions communicated with the relevant promotion.

Unless expressly stated otherwise, promotions cannot necessarily be combined.

A promotion does not remove mandatory consumer rights.

15. Intellectual Property

The website and its original content, layout, graphics, text, branding and other protectable elements may be protected by intellectual-property laws.

Except where legally permitted, users may not reproduce, distribute, modify, exploit or commercially use protected website material without appropriate authorisation.

Third-party trademarks remain the property of their respective owners.

16. Acceptable Use

You must not knowingly introduce malware or malicious code, attempt unauthorised access to website systems, interfere with website security, use automated systems in an abusive manner, impersonate another person, submit fraudulent orders or use the website for unlawful purposes.

We may restrict access where reasonably necessary to protect the website, customers or legitimate business interests.

17. Third-Party Services

Our store may integrate third-party services including payment services, logistics services, analytics services and Shopify functionality.

Independent third-party services may be governed by separate terms and privacy notices.

18. Website Availability

We may perform maintenance or modifications to the website.

We do not guarantee uninterrupted access at every moment, but nothing in this section limits obligations relating to orders already accepted or mandatory consumer rights.

19. Liability

Nothing in these Terms excludes liability where exclusion is prohibited by law.

In particular, these Terms are not intended to remove statutory rights concerning product conformity, consumer protection, personal injury caused by legally attributable fault, fraud or other liability that cannot lawfully be excluded.

To the extent legally permissible, we are not responsible for losses caused solely by events outside our reasonable control or by the customer's own unlawful or materially negligent conduct.

20. Force Majeure

Where performance is prevented or materially delayed by an event legally qualifying as force majeure or another event for which mandatory law provides relief, the consequences will be determined under applicable law.

This clause does not deprive consumers of mandatory cancellation, reimbursement or delivery rights.

21. Complaints

Customers should first contact us regarding complaints:

info@hillhousehomehx.shop

Please provide sufficient information for us to identify the order and investigate the issue.

22. Consumer Mediation

French consumer law requires relevant professionals to appoint an eligible consumer mediator before disputes arise and to provide consumers with the mediator's name, address and website details. Consumer mediation is generally free for the consumer.

The genuine mediator selected by the operator of hillhousehomehx.shop must therefore be separately identified on the website and contractual sales information. A mediator cannot responsibly be invented or assigned solely for the purpose of drafting these Terms.

23. Applicable Law and Jurisdiction

These Terms are intended to operate consistently with French law where the sale is directed to consumers in France.

Nothing in these Terms deprives an EU consumer of mandatory protections available under the law that applies to the consumer.

Any jurisdiction provision will apply only to the extent permitted under mandatory consumer law.

24. Severability

If any provision of these Terms is held invalid, unlawful or unenforceable, the remaining provisions will continue to operate to the extent legally possible.

25. No Waiver

Failure to enforce a contractual right on one occasion does not automatically constitute a permanent waiver of that right.

This clause does not modify statutory limitation periods or mandatory consumer protections.

26. Changes to These Terms

We may update these Terms when necessary to reflect changes to our business, services or applicable requirements.

Changes will not retroactively remove rights already acquired by consumers under an existing transaction where doing so would be unlawful.
